Does Montana require a state money transmitter licence?

No. The Montana Department of Banking and Financial Institutions does not license or regulate money transmitters, which makes Montana the only US state without such a regime. Money transmission, currency exchange and virtual asset activity conducted from Montana do not require a state transmitter licence.

What does a Montana MSB still have to comply with?

Federal obligations apply in full. The business registers as a money services business with FinCEN, maintains a written AML programme with a designated compliance officer, carries out independent testing, files suspicious activity and currency transaction reports where thresholds are met, and keeps records under the Bank Secrecy Act. The entity itself must also be properly formed and in good standing with the Montana Secretary of State.

Can a Montana MSB serve customers in other US states?

Only where it satisfies those states' own rules. The absence of a Montana licensing regime does not extend beyond Montana. Actively soliciting or serving residents of another state generally brings that state's money transmitter law into play, so a nationwide operation still needs a state-by-state licensing plan.
